
This is to inform Signatories that the Disclosure (Scotland) Act 2020 (Disclosure Act) is now live. Here is a summary of key information.
The Disclosure Act aims to improve the disclosure system in Scotland by removing unnecessary barriers for individuals with convictions seeking employment or other opportunities, and to enhance the PVG scheme.
Key Changes Under the Disclosure Act:
- Membership of the PVG scheme is now a legal requirement for those carrying out a regulated role.
- The Act replaces the concept of ‘regulated work’ with ‘regulated roles’.
- A 3-month grace period, from the 1st April – 30th June, is available for PVG scheme applications to be submitted for individuals currently in a regulated role.
- The Act introduces simplified disclosure products and provides individuals with greater control over their information.
- It implements an individualised approach to the disclosure of childhood offending and rights of review for disclosed convictions, to enhance fairness and proportionality.
- Disclosure Scotland now has the ability to impose conditions on PVG scheme members who are under consideration for listing.

Key Changes for Applicants/Volunteers
Under the Disclosure Act, applicants have new responsibilities. It is important to continue informing them of these requirements to avoid recruitment delays.
Sharing Disclosure Results
- Applicants must provide consent to share a copy of their disclosure result with the recruiting organisation OR notify Disclosure Scotland of their intent to seek a review of the disclosure content.
- Applicants have 14 days, from the date of completion, to share their disclosure result or notify Disclosure Scotland of their intent to seek a review.
- Applicants will receive reminders to share their disclosure result 5 and 12 days after the result is ready.
- Applicants can no longer request a paper copy of the disclosure result via their online account.
